This is an agreement between you and Canadian Cart (“Canadian Cart,” “we,” “us,” or “our”). It sets out the terms and conditions (the “Service Terms”) that apply to your use of Canadian Cart products and services, including customer assistance, repairs to smartphones and electronic tablets (“Device”), warranties and guarantees provided by Canadian Cart, and purchases of certified pre-owned Devices or accessories (collectively, the “Products and Services”). The Service Terms, together with our Privacy Policy, form the agreement between you and Canadian Cart for the Products and Services (the “Agreement”).
By using the Products and Services you are agreeing to the terms of the Agreement. IF YOU DO NOT AGREE TO THESE SERVICE TERMS, YOU MAY NOT USE THE PRODUCTS AND SERVICES.Canadian Cart reserves the right to amend any term of the Agreement, including rates and additional charges, at any time by posting notice of the amendment on our website. Your continued use of the Products and Services following any amendment shall be deemed your acceptance of the amended Agreement.
1. What Canadian Cart Provides
a) Repair Services and Quotes
Canadian Cart will make all reasonable efforts to repair your Device with care and skill. Prior to any repair, Canadian Cart will provide you with a quote for the estimated cost of the repair based on the information you provide. Once you accept the quote, we will proceed with the repair. If the actual cost of repair is higher than originally quoted, we will obtain your consent before proceeding further. Any time estimate given for completion of a repair is an estimate only and does not form an obligation under these Service Terms.
All quotes exclude applicable taxes and are valid only for the day they are provided, as prices may fluctuate.
When your Device is repaired and ready for collection, Canadian Cart will notify you through your preferred contact method.
b) Sale of Pre-Owned Devices
Canadian Cart sells certified pre-owned devices through our online store. Each device is inspected and tested prior to listing, and is sold subject to the Pre-Owned Devices Warranty Terms & Conditions set out in Section 4 of this Agreement.
c) Guarantees and Warranties
The guarantees and warranties applicable to repairs and to pre-owned device purchases are set out in Sections 3 and 4 of this Agreement, respectively.
d) General Terms
Our Products and Services are provided on an “as is” and “as available” basis. To the fullest extent permitted by applicable law, Canadian Cart disclaims all warranties, representations, and conditions relating to the Products and Services, except as expressly set out in this Agreement. The express warranties set out in Sections 3 and 4 are exclusive and in lieu of all other warranties, whether oral or written, statutory, express, or implied, including any implied warranty of merchantability or fitness for a particular purpose, to the extent permitted by law.
2. Online Purchases
a) Ordering Process
To make a purchase on the Canadian Cart website, you must be a registered account holder or check out as a guest. In either case, you must be the age of majority in your province or territory of residence, and you will need to provide certain personal information so your order can be processed. You are responsible for ensuring the continued accuracy of this information.
b) Price
All prices are listed in Canadian currency and all charges are processed in Canadian currency. Prices displayed on our website are subject to confirmation, do not include shipping fees or applicable sales tax, and are subject to change without notice at Canadian Cart's sole discretion. Shipping and taxes will be displayed at checkout prior to your final order submission.
c) Availability and Description of Products
Purchases on our website are subject to availability. Canadian Cart reserves the right to limit the quantities of any product and some items may be unavailable for purchase online. Merchandise in your shopping cart is not reserved.
While we attempt to be accurate in our product descriptions, we do not warrant that product descriptions or other content on our website is complete, reliable, current, or error-free. If a product you purchase is not as described, your sole remedy is to return it in accordance with our returns policy below.
d) Rejection or Cancellation of Orders
Canadian Cart may cancel orders and refund payment due to pricing errors, unavailability of inventory, or for any other reason. If we reject your order, we will have no obligation to fulfill it and you will have no obligation to pay for it.
e) Payment
You may pay using Visa, Mastercard, American Express, or other payment methods made available at checkout, and you authorize Canadian Cart to charge the applicable card or payment service for the purchase price. You represent that you are the account holder of the payment method used. If your payment is declined, your order will not be shipped.
f) Shipment
Orders are shipped by our third-party carriers. Once your order has shipped, you will receive a shipping confirmation and your payment method will be charged. Orders cannot be shipped outside Canada or to freight-forwarding addresses. Shipping windows are estimates only; Canadian Cart is not responsible for delays in delivery.
g) Returns & Exchanges
If you are not satisfied with your purchase, you may return it for an exchange provided that:
- You have the original sales receipt or order confirmation email.
- The product is returned in its original condition and packaging.
- The return is initiated within 15 days of the purchase date.
- We do not have a refund policy.
Devices found to be defective within the first 15 days of purchase will be replaced free of charge. Online orders may be returned to a Canadian Cart location or shipped back at the purchaser's expense. Please remove all personal data from any device prior to returning it β Canadian Cart is not responsible for data left on returned items.
3. Repair Warranty Terms & Conditions
What is Covered
Canadian Cart offers a limited warranty of ninety (90) days on repairs performed by our technicians, covering the replacement part(s) installed and the labour associated with that repair.
This warranty applies only to the specific part(s) replaced by Canadian Cart during the repair. It does not extend to any other component of the Device or to any pre-existing condition or issue.
What is Not Covered
This warranty does not apply, and is void, in the following circumstances:
- The Device develops a different fault or malfunction unrelated to the part that was replaced.
- The Device has, or subsequently develops, liquid or water damage. Repairs performed on liquid-damaged devices are carried out on a “dead approval” basis, meaning Canadian Cart cannot guarantee the long-term functionality of the Device following the repair.
- The installed part is cracked, broken, bent, scratched, or otherwise shows signs of physical or accidental damage.
- The Device has been opened, repaired, or tampered with by anyone other than a Canadian Cart technician after the repair was completed.
- The issue results from drops, water exposure, misuse, software problems, power surges, or normal wear and tear.
Claims Procedure
To make a warranty claim, bring the Device to us along with your original repair receipt. You may also contact us by phone or through our Facebook page to arrange an inspection.
All warranty claims are subject to inspection by a Canadian Cart technician to determine whether the issue falls within the scope of this warranty.
Your Responsibility
You are responsible for backing up your data prior to the repair. Canadian Cart is not responsible for any loss of data occurring during the repair process.
Limitation
This warranty covers replacement parts and labour only, as described above, and does not cover damage caused by drops, water, misuse, software issues, power surges, or normal wear and tear. The final decision on any warranty claim will be made following inspection of the Device by our technician.
4. Pre-Owned Devices Warranty Terms & Conditions
What is Covered
Canadian Cart offers a limited warranty of ninety (90) days from the date of purchase on certified pre-owned devices (“CPO Devices”) sold through our online store, covering defects in materials and workmanship affecting the hardware of the CPO Device.
This warranty applies only to the hardware components of the CPO Device as sold, and does not extend to software, accessories, or peripheral equipment sold or provided with it.
What is Not Covered
This warranty does not apply, and is void, in the following circumstances:
- The defect or damage is caused by liquid or water exposure.
- The CPO Device has physical damage, including but not limited to cracks or scratches on the screen, camera lens, or housing, that occurs after purchase.
- The CPO Device serial number or IMEI number has been removed, erased, defaced, altered, or is illegible.
- The defect is caused by rough handling, unauthorized modification, unauthorized repair, use of unauthorized parts, accidents, or normal wear and tear.
- The CPO Device has been opened, repaired, or tampered with by anyone other than a Canadian Cart technician.
- The defect is caused by a faulty accessory not approved or provided by Canadian Cart, or by a malfunction of the cellular network.
Claims Procedure
To make a warranty claim on a CPO Device, contact us with your original purchase receipt or order confirmation and a description of the issue. You may be asked to bring the Device to a Canadian Cart location, or to ship it to us, for inspection.
All warranty claims are subject to inspection by a Canadian Cart technician to confirm the CPO Device qualifies for coverage under this warranty.
Your Responsibility
You are responsible for backing up your data prior to sending in the CPO Device for warranty service. Canadian Cart is not responsible for any loss of data occurring during inspection or repair.
Limitation
If a covered defect is confirmed, Canadian Cart will repair the CPO Device at no charge or, where repair is not possible due to parts availability, provide an equivalent replacement device or a refund of the purchase price, at Canadian Cart's discretion. This warranty does not cover cosmetic wear that does not affect functionality. The final decision on any warranty claim will be made following inspection of the CPO Device by our technician.
5. Your Responsibilities
a) Data Back-up
It is your responsibility to back up all data, software, and programs on your Device prior to submitting it for repair, or prior to sending it in for a warranty claim. Canadian Cart accepts no liability for loss or corruption of any data, information, software, or programs stored on your Device.
b) Device Abandonment
Canadian Cart will notify you through the contact information you have provided when your Device has been repaired and is available for collection. Canadian Cart is not responsible for any Device not claimed within 45 days from the date you are first notified that it is ready for pick-up. After such time, Canadian Cart may dispose of the Device at its sole discretion.
c) Accurate Information
You agree to provide accurate and complete information when purchasing a Product or Service, or when submitting a Device for repair, and to promptly update that information if it changes.
6. Privacy
You agree that the Canadian Cart Privacy Policy, as it may be updated from time to time, applies to your use of the Products and Services. You consent to the collection, use, and disclosure by Canadian Cart of your personal information collected in connection with the Products and Services, for the purposes identified in our Privacy Policy.
Canadian Cart may also offer third-party products and services. These third-party products and services are governed by their own terms, conditions, and privacy policies.
